CASSATION

It is sometimes the last opportunity to change the decision of the court as in criminal, administrative, economic or civil cases. At the moment in the judicial system there are several courts considering case in cassation instance and is specialized Higher courts. According to article 31 of the Law of Ukraine N 2453-VI of 07.07.2010 "On judicial system and status of judges" determined the types and composition of high specialized courts. Thus, in the system of courts of General jurisdiction are high specialized courts as courts of cassation for civil and criminal, administrative cases. Higher specialized courts are: The high specialized court for civil and criminal cases The Supreme economic court of Ukraine, The Supreme administrative court of Ukraine.

THE POWERS OF THE HIGH SPECIALIZED COURT The high specialized court: 1) considers cases of corresponding judicial jurisdiction in cassation procedure in accordance with the procedural law; 2) in the cases stipulated by the procedural law shall consider cases within their jurisdiction as a court of first or appellate instance, and also handles cases in the case of the establishment of an international judicial institution whose jurisdiction is recognized by Ukraine, violation by Ukraine of international obligations in resolving the case by the court, if by results of consideration of the question of the admission of a case the Supreme Court of Ukraine will be it was found that such case is subject to consideration of the higher specialized court; 3) analyze court statistics, study and generalize the judicial practice; 4) provides methodological assistance to courts of lower level with the objective of uniform application of norms of the Constitution and laws of Ukraine in court practice on the basis of its generalization and analysis of court statistics; provides the specialized courts of lower level with recommendatory explanations on issues of application of legislation according to the decision of cases within their jurisdiction; 5) exercise other powers defined by law.
