According to the article 36 code of criminal procedure, the Prosecutor in the supervision over observance of laws during pre-trial investigation in the form of procedural guidance pre-trial investigation, is authorized to: instruct the investigator, pre-trial investigation body carrying out in established by the Prosecutor of the term investigative (search) actions, covert investigatory (search) actions, other proceedings, or to give instructions regarding their conduct or to participate in them, and in necessary cases - to personally conduct investigative (search), and the proceedings in the manner specified by the Code; to entrust the conduct of investigative (search) actions and covert investigative (search) actions with the relevant operational units.
According to the requirements of article 40 of the code of criminal procedure the investigator pre-trial investigation body shall be responsible for the legality and timeliness of the implementation procedure.
According to article 41 of the criminal procedure code of Ukraine, of operative units of the National police is carried out by investigators (search) actions and covert investigative (search) actions in criminal proceedings upon the written order of the investigator, the Prosecutor. During the execution of the instructions of the investigator, Prosecutor, employee of the operational unit is the investigator's authority. Orders of the investigator, the Prosecutor regarding the conduct of investigative (search) actions and covert investigative (search) actions is required to perform the operational unit.
