Article 307. Illegal production, manufacture, acquisition, storage, transportation, transfer or sale of narcotic drugs, psychotropic substances or their analogues

1. Illegal production, manufacture, acquisition, storage, transportation or forwarding for the purpose of sale, as well as illegal sale of narcotic drugs, psychotropic substances or their analogues -

shall be punishable by deprivation of liberty for a term of four to eight years.

2. The same actions committed repeatedly or by prior conspiracy by a group of persons or by a person who previously committed one of the crimes provided for in articles 308-310, 312, 314, 315, 317 of the Criminal Code of Ukraine, or involving a minor, as well as the sale of narcotic drugs means, psychotropic substances or their analogues in places intended for conducting educational, sports and cultural events, and in other places of mass stay of citizens, or the sale or transfer of these substances to places of deprivation of liberty, or if the subject of such actions were rkoticheskie drugs, psychotropic substances or their analogues in large amounts or especially dangerous narcotic drugs or psychotropic substances -

shall be punished by imprisonment for a term of six to ten years with confiscation of property.

3. The actions envisaged by parts one or two of this article committed by an organized group, and also if the subject of such actions were narcotic drugs, psychotropic substances or their analogues in especially large amounts, or committed with the involvement of a minor or against a minor,

shall be punished by imprisonment for a term of nine to twelve years with confiscation of property.

4. A person who voluntarily surrendered narcotic drugs, psychotropic substances or their analogues and indicated the source of their acquisition or contributed to the disclosure of crimes related to their illegal circulation is released from criminal liability for the illegal manufacture, production, acquisition, storage, transportation, transfer (part the first of this article, the first part of Article 309 of this Code).
