LAW OF UKRAINE ON INTERNATIONAL PRIVATE LAW

For the purposes of this Law, the following meanings:
     1) private-law relationship - a relationship based on the principles of legal equality, free will, property independence, the subjects of which are natural and legal persons;
     2) a foreign element - a sign that characterizes private law relations regulated by this law, and it appears in one or more of the following forms:
     at least one party is a legal citizen of Ukraine who reside outside of Ukraine, a foreigner, a stateless person or a foreign legal entity;
     legal entity is a foreign country;
     the legal fact, which creates, modifies or terminates the legal relationship, whether there was a foreign country;
     3) The conflict rule - the rule which determines the right of the state to be applied to legal relations with a foreign element;
     4) choice of law - the right of participants to identify legal right of the state to be applied to legal relations with a foreign element;
     5) autonomy of will - the principle that participants in legal relations with a foreign element can make a choice of law to be applied to the relevant legal relationships;
     6) legal qualification - determination of the law applicable to legal relations with a foreign element;
     7) renvoi - re reference conflict rule of law of a foreign country to the rule of law state conflicts rule which is sent to this foreign rule of law;
     8) reference to the law of a third country - a reference conflicts rule of law of a foreign state, determined in accordance with this Act, to the rights of third States;
     9) circumvention of the law - application to legal relations with a foreign element of the right of other than the right provided for by applicable law;
     10) Recognition of a foreign judgment - the spread of legal force of the decision of a foreign court on the territory of Ukraine in the manner prescribed by law;
     11) international treaties of Ukraine - the current international treaty of Ukraine accepted as binding by the Verkhovna Rada of Ukraine.
     Scope of the Act
      1. This Law applies to such issues arising in the field of private law relations with a foreign element:
     1) determination of the applicable law;
     2) procedural legal capacity of foreigners, stateless persons and foreign legal entities;
     3) the jurisdiction of the courts of Ukraine cases with a foreign element;
     4) execution of court orders;
     5) recognition and enforcement in Ukraine of foreign judgments.
