Law on citizenship of Ukraine

LAW ON CITIZENSHIP OF UKRAINE

The Law of Ukraine On Citizenship of Ukraine N 2235-III of January 18, 2001 was published in the official edition number 39 of 01.03.2001 Law of Ukraine On Citizenship of UkraineGovernmental Courier and entered into legal force. He was amended seven times in preriod from 2005 to 2013 in 20014 and 2015 amendments to the law was not.
          
This law under the Constitution of Ukraine determines the legal status of citizenship Ukraine, the grounds and procedure for acquiring and termination, competency of state authorities involved in matters of citizenship of Ukraine, order of appeals against decisions on citizenship, actions or omissions of public authorities, their officials and officers.

According to the law a citizen of Ukraine - a person who has acquired citizenship of Ukraine in the legislation of Ukraine and international agreements Ukraine;

     The legislation of Ukraine on citizenship is based on the following principles:

1) Single citizenship - the citizenship of Ukraine, excluding possibility of existence of citizenship of administrative territorial units of Ukraine. If a citizen of Ukraine acquires citizenship (nationality) of another state or states, then in legal relations with Ukraine he is recognized as the citizen of Ukraine. If a foreigner acquires the citizenship of Ukraine, then in legal relations with Ukraine he is recognized as the citizen of Ukraine;
2) prevention of statelessness cases;
3) inability depriving a citizen of Ukraine citizenship
Ukraine;
4) recognition of citizen of Ukraine to change citizenship;
5) inability to automatic citizenship Ukraine foreigner or a person without citizenship due to marriage to a citizen of Ukraine or the citizenship of Ukraine by his wife (husband) and automatic termination of citizenship of Ukraine by a spouse due to termination of marriage or termination of citizenship of Ukraine by another spouse;
6) equality before the law of citizens of Ukraine irrespective of grounds, order and moment of their acquisition of citizenship of Ukraine;
7) retain citizenship of Ukraine irrespective of the place of residence of a citizen of Ukraine.

Questions of nationality are governed by the Constitution of Ukraine Ukraine indicated Law and international treaties of Ukraine. If an international treaty of Ukraine sets other rules than those contained in this Law, the rules international treaty.

Grounds for acquiring the citizenship of Ukraine

     The citizenship of Ukraine is acquired:

     1) by birth;

     2) by territorial origin;

     3) due to the citizenship;

     4) due to restoration of the citizenship;

     5) Due to adoption;

     6) due to the establishment of a child custody or care placement in a children's institution or a health institution in family-type orphanage or a foster family or when education in family foster caregiver; (Item 6 of Article 6 in Law N 2663-IV (2663-15) of 16.06.2005)

     7) as a result of the establishment of the person recognized by court incompetent, guardianship;

     8) due to citizenship of Ukraine of one or both parents;

     9) due to the recognition of parentage or establishing paternity or maternity; (Paragraph 9 of Article 6 the Law N 2663-IV (2663-15) of 16.06.2005)

     10) other grounds foreseen by the international treaties of Ukraine.
