Our Office treat foreign nationals who are in the territory of Ukraine and who have any need for in the State migration service of Ukraine reference (information) on the failure of the citizenship of Ukraine and absence of applying for citizenship of Ukraine.

Such certificate is required to recover lost documents or other actions in the migration services of the countries of their citizenship.

The problem is that such certificates are issued by the migration service at the place of registration of the foreigner. However, who should produce them, if the foreigner is not registered and not set by law.

In our opinion, the solution to this problem may be attorney's request.

According to part 2 of article 24 of the law of Ukraine "On advocacy and legal practice" organ of sta

te power, their officials and officers of which directed law request, are obliged not later than five working days from the date of receipt of the request to give the lawyer relevant information. According to part 3. 24 of the law of Ukraine "On advocacy and legal practice" the refusal in providing information on attorney's request, untimely or incomplete providing information, providing information that is untrue, entail the responsibility established by the law, except in cases of refusal in providing information with limited access.
