Total distrust, generated by the general chaos in relations between people, the inability of the state to ensure normal relationships and the protection of human property rights, leads to further degradation of our society. Everyone steals and cheats everywhere, this is becoming the norm. However, this state of affairs should not take place in a civilizational society.

The car seller inflates the mileage, artificially inflating the price of the car. A market vendor places a magnet on the scale or manipulates it by holding it.

The judge takes money for mitigation of responsibility in a case where the prosecution has clearly overstated its qualifications. The prosecutor offers to enter into an agreement with him and admit guilt, realizing that no evidence of guilt has been collected.

The borrower writes a receipt, realizing that he has no property and it is impossible to recover money from him through the court. Another shows a potential victim the opportunity to make quick money, realizing that it is impossible to earn money that way, and after receiving the money he simply hides.

An entrepreneur does not pay taxes claiming that there is no profit at the enterprise, or that it is 3 percent of turnover. A car dealership sells a problematic car that is subject to a civil dispute, knowing this fact.

The police are not opening criminal proceedings, claiming that this is all a civil matter. And this in itself is fraud on the part of the police officers.

The courts, if interested, also support the above position. And this in itself is fraud, or at least aiding fraud.

The parliamentary candidate claims that he has experience and education, which he does not have, and uses shady schemes to win elections. As a result, the same scammers come to power.

All this is fraud, that is, a crime for which the perpetrator must be held accountable. At the same time, the state is obliged to ensure the inevitability of punishment commensurate with the crime, isolate the fraudster from society and force him to compensate for the damage with his labor.

Avoiding the liability of fraudsters. Unacceptable, but true

The country's leadership is objectively suspected of stealing property, that is, resources that belong to citizens of Ukraine.

In 2023, with the help of Parliament, the possibility of applying private law instead of arrest to persons found guilty of abuse of official position, bribery and bribery of an official of a legal entity, a new type of punishment - probation supervision, was introduced. That is, in fact, such persons will not actually be punished either.

In addition, one of the most used in the field of economics is the composition of fraud as a criminal offense.

In the practice of Ukrainian legal proceedings in many cases of bribery, corruption and malfeasance, it is the criminal law provided for in Art. 190 of the Criminal Code of Ukraine (fraud), since in court it is possible to prove that the corrupt person did not act as an official.

On August 11, 2023, a law amending Article 190 of the Criminal Code of Ukraine came into force. In accordance with this, part 4 of this article was renamed part 5.

Because of such simple manipulations, fraudsters who committed fraud on an especially large scale before August 11, 2023 will not be prosecuted for what they committed, since it is impossible to reclassify their actions as part 5, and part 4 now contains a different crime, which not applicable to other actions.

Amendments to Article 190 of the Criminal Code of Ukraine became possible by making an amendment before the second vote without discussing this amendment in the relevant committees of parliament, in the scientific and expert institute, the legal community and was not submitted for discussion to citizens of Ukraine. That is, the changes were made by misleading the people of Ukraine.

That is, it can be stated that government officials are preparing ways out for themselves and changing legislation so that in the future, when there is a change of government, they cannot be brought to criminal liability.

All this will lead to the impossibility of reimbursing the material and moral damage caused to the citizens of Ukraine from the illegal activities of fraudsters.
