Compliance with the organization's current Bank operations

Commercial banks on a contractual basis carry out settlement and cash services of enterprises, institutions, organizations and citizens by fulfilling their orders for transfer of funds from the accounts (article 51 of the Law "On banks and banking activity").

Funds of legal entities subject to mandatory storage in banks, with the exception of cash at the box office within the limits set by the servicing Bank. Conditions settlement and cash services for clients of the Bank are reflected in their contracts.

General procedure for cashless payments, forms, documents, etc. defined in the regulations No. 135 dated 29.03.2001 instruction On non-cash payments in Ukraine in the national currency".

The instruction establishes General rules for settlement banks, legal and physical persons with use of payment instruments in the form of: memorial order; payment order; payment request-orders; payment requirements; calculation of the check; letter of credit.

In this case, note that the use of Bank cards and bills as payment documents are governed by other regulations of the NBU. Rather narrowly and clearly defined circle of claimants - state performer, the tax authorities and enterprises (coercing the recoveries on the basis of recognized claims), on the basis of documents and in the cases determined by law, are entitled to complete and submit to the Bank payment documents in a forced write-off of means from accounts of payers.

According to this Instruction, the payer's Bank receives documents from clients during the business day, which is regulated mode of operation of the Bank. Calculations according to the documents received by the payer's Bank within a banking day, the Bank implements the same day.

In the upper right corner marks the date of receipt of these documents. If documents are received after the expiry time regulated by the Bank to work with clients in such documents, also stamped "evening". The execution date of the billing document is affixed in the lower right corner. If the date of the payment document matches the date of the transaction Bank, the date of its receipt by the Bank not affixed.

The payee's Bank shall credit the funds to your account no later than the next working day after receiving the information from the Clearinghouse.

In cases where a settlement is effected without the use of a system of electronic interbank accounts, the accounting documents of companies are delivered to the banks by Express mail (SCS) in accordance with the Rules of admission, testing and delivery of banking institutions via special courier service of the Ministry of communications of Ukraine. The regulatory limit for the submission of settlement documents, compliance for exceeding the term of their circulation, etc. set forth in the Law of Ukraine "On payment systems and money transfer in Ukraine" from 05.04.01, No. 2346.

According to claim 10 Instruction No. 135 the disposal of the claimant on compulsory withdrawal from the account of the payer, are accepted by the banks regardless of the availability of sufficient surplus funds, and they are partially within the available balance and the outstanding money returned to the claimant.

Named manual in detail regulates the circulation of documents in the Bank and the obligation of verification of documents.

When checking this issue should pay attention to customer complaints about the violation of the Bank's normative timeframe for completion of settlement documents, and inspections conducted by the supervising authorities (DPI, NBU).
