WHAT to DO IN case of accident (road traffic accident)?

According to the law of Ukraine "On compulsory insurance of civil liability of owners of vehicles" in the event of a traffic accident, which can be the basis for the implementation of insurance benefits (maintenance payments), the driver of the vehicle, prichastny to such incident shall:

- to adhere to under the road rules duties of a driver involved in a traffic accident;

- to take measures to prevent or reduce further damage;

- to inform other persons involved in this incident, about himself, his place of residence, the name and address of the insurer and to provide information about mausica insurance policies;

- immediately but not later than three working days from the date of occurrence of a traffic accident, in writing, to provide the insurer with whom a contract of compulsory insurance of civil liability (in cases stipulated by article 41 of the Law, - MTIBU), a message about a traffic accident installed MTIBU sample, as well as information about the whereabouts of their vehicles and damaged property, contact phone number and address. If the driver of the vehicle for good reasons was not able to perform these duties, he should document it.

In the event of road traffic accidents involving insured vehicles, provided that no injured dead) people, and with the consent of the drivers of vehicles on the circumstances of its Commission, in the absence of signs of alcoholic, narcotic or other intoxication or being under the influence of medicines, reducing attention and reaction speed, these drivers have the right to jointly compose a message about a traffic accident (Euro Protocol).

In this case, the drivers of vehicles after composing this message, have the right to leave the scene of a traffic accident and are exempt from the obligation to inform the traffic Police of Ukraine about its occurrence.

In the case of execution of documents about dorozhno-transport incident without participation of authorized employees of the state traffic Inspectorate of the Ministry of internal Affairs of Ukraine the amount of insurance indemnity for damage caused to property of the victims, may not exceed the maximum amount approved by the Authorized body on representation of MTIBU.

Drivers and owners of vehicles involved in a traffic accident, the owners of the damaged property must retain the damaged property (vehicle) in the condition in which it was found after a traffic adventure, until then, until it has been inspected appointed by the insurer (in the cases provided for in article 41 of the Law, - MTIBU) representative (employee Adjuster or expert), and provide him the opportunity to inspect the damaged property (vehicles).

The persons referred to use are exempt from the obligation to preserve the damaged property (vehicle) in the condition in which it was found after a traffic accident, if not through their fault within ten working days after the insurer receives a message about a traffic accident his authorized representative has not arrived at the place of residence of such damaged property.

In the case of employees of the state traffic Inspectorate of the Ministry of internal Affairs of the Relevant documents about a traffic accident they also establish and record the necessary information on compulsory insurance of civil liability of participants of this incident and encourage the representatives of the underwriters (MTIBU) in the conduct of inspection of the scene of a traffic accident and the vehicles involved in it.
