Civil law regulated the moral and property relations (Civil Affairs), based on legal equality, free will, property independence of their participants.
The proprietary relationships based on administrative or other authoritative subordination of one party to the other party, as well as tax and budget relations civil law is not applicable, unless otherwise provided by law.
The participants of civil relations are individuals and legal entities, the state of Ukraine, the Autonomous Republic of Crimea, local communities, foreign governments and other entities of public law.
The general principles of civil law are:
1) the inadmissibility of arbitrary interference in the private sphere of life;
2) the inadmissibility of deprivation of property rights, except in cases established by the Constitution of Ukraine and the law;
3) freedom of contract;
4) freedom of entrepreneurial activity that is not prohibited by law;
5) judicial protection of civil rights and interests;
6) fairness, reasonableness and good faith.
Principles of Civil Law of Ukraine Constitution of Ukraine. The main act of civil legislation of Ukraine is the Civil Code of Ukraine. Acts of civil law are also other laws of Ukraine, adopted in accordance with the Constitution of Ukraine and the Civil Code. Civil relations can be regulated by acts of the President of Ukraine in cases established by the Constitution of Ukraine. Acts of civil law is also the Cabinet of Ministers of Ukraine. If the Cabinet of Ministers of Ukraine contrary to the provisions of the Code or any other law, the relevant provisions of the Code or any other law. Other state authorities of Ukraine, authorities ARC may issue regulations governing civil relationships in cases and within the limits set by the Constitution of Ukraine and the law.
Civil relations are governed by the same throughout the territory of Ukraine.
The parties may conclude an agreement which is not provided for acts of civil law, but meets the general principles of civil law. The parties have the right to settle in the contract, which provided for acts of civil law, their relationship not covered by these acts. The parties to the agreement may derogate from the provisions of civil law and regulate their relations at their own discretion. The parties to the agreement can not derogate from the provisions of civil law, if these acts clearly stated this, and if the parties bound by provisions of civil law stems from their content or from the nature of relations between the parties.
Civil relations may be regulated by custom, including business practices.
If civil relations are not regulated by the Code and other acts of civil law or contract, they are governed by the legal provisions of the Code, other acts of civil legislation regulating similar in content civilian relations (analogy of law). Failure to use the analogy of the law for regulating civil relations are governed by the general principles of civil law (analogy of law).
The grounds of civil rights and obligations, in particular:
1) agreements and other legal documents;
2) the creation of literary and artistic works, inventions and other results of intellectual and creative activity;
3) The problem of property (material) and moral harm to another person;
4) other legal facts.
