A deferment from the army

1. The draft exemption (deferment from military service) is granted to conscripts by decision of the regional (city) conscription Commission in accordance with this Law for family reasons, for health reasons, for education and continuing professional activities.

2. A deferment from the army for family reasons at their request be granted to conscripts who are:

1) a disabled father and a disabled mother or a lone father (lone mother of disabled) or disabled individuals under guardianship, trusteeship or the content of which was conscript, or persons over whom the conscript carries out custody or guardianship, if they have no other able-bodied persons - citizens of Ukraine, according to the laws to contain them. The incapacity of these persons is determined in the manner prescribed by law;

2) minors of relatives (full or half) brothers and sisters or disabled relatives (full or half) brothers and sisters regardless of their age, if they have no other able-bodied persons, other than the recruit, obliged under the law to support them;

3) lone father or lone mother, whose contents are two or more minor children until the eldest of them of age if the employment of the recruit;

4) of a child under three years of age or a child older than three years, being raised without a mother due to her death or court order;

5) two or more children;

6) a disabled child;

7) wife of a disabled;

8) pregnant wife.

3. A deferment from the army for family reasons, on own request may be granted to a conscript who is the person from among children-orphans and children deprived of parental care.

5. If the call to military service subject to several sons at the same time, a deferment may be granted to one of them for their desire with regard to suggestions of parents during the military service of the brethren, to the retirement of one of them.

6. District (city) draft Board may decide on granting the conscript deferment from conscription to military service for family reasons, despite the reluctance of the conscript to use it, based on the fact that his appeal may substantially worsen the financial situation of individuals, which in accordance with the laws it should contain.

7. A deferment from the army for health reasons for up to one year is granted to conscripts who are recognized at the time of medical survey temporarily unfit for military service.

8. A deferment from the army for education for the entire period of study is granted to citizens of draft age who are enrolled:

in secondary and vocational schools with day students. In the case of achieving such recruits 21 years of age the delay expires;

in higher educational institutions with full-time study, including during receiving the next highest educational qualification of higher education;

in the middle or the higher spiritual educational institutions with full-time study;

in internship, postgraduate study or doctoral studies with a full-time or on the job.

9. The right to deferment from the army for education are also citizens of Ukraine within international treaties of Ukraine are studying in educational institutions of other States.

10. A deferment from the army for education is given once for the period of study, and the citizens of military age, expelled from educational institutions on their own, for failure to comply with the curriculum, breach of contract or lack of discipline forfeit the right to deferment from military service regardless of their re-admission to an establishment of higher education or resume at a higher education institution.

11. Citizens of military age who have undergone training in connection with obtaining an academic leave for health or family reasons, to care for close relatives, mentioned in the third paragraph of the eleventh part of article 15 of this Law, granted the right to deferment from military service do not lose.

12. In case of transfer recruits who are studying in institutions of higher education to day students, to study at another institution of higher education with this form of education the right to deferment from military service is not lost.

13. The deferment from military service to continue professional activities provided such citizens of military age:

pedagogical workers with higher education, main place of employment which are General educational institutions, with the full load on the post - for the whole period of their work in the specialty;

health care workers with the full load on the post - for the whole period of their work in rural areas;

clergy who have completed higher or secondary religious educational institutions and hold a position in the religious organizations acting under the Charter (statutes), registered in the prescribed manner, - while the duties of the priest;

village, settlement, city chairmen for a period which they exercise these powers;

persons who have scientific degree of candidate (doctor) of Sciences and work in positions in the specialty according to the group of specialties of the branch of science, which was awarded the scientific degree, - for the whole period of their work in this specialty;

the reservists - for the entire period of service in the military reserve;

police - for the entire period of their service.
