From January 1, 2019, the provision of a certificate of bringing to criminal responsibility, the absence (presence) of a criminal record or restrictions provided for by the criminal procedural legislation of Ukraine (hereinafter referred to as the Certificate) is issued to clear violations of the established deadlines.

Territorial service centers of the Ministry of Internal Affairs and the Department of Informatization of the Ministry of Internal Affairs are delaying the issuance of these certificates. This creates tension and dissatisfaction of citizens.

A criminal record can also be provided online, but this service also malfunctions and is not very reliable. In addition, to use this method, an electronic digital signature (of an individual) or Bank ID is necessary.

A certificate of good conduct is needed in the case of:

• registration for work,

• registration of a visa for going abroad to participate in the tender,

• adoption,

• establishing custody

• registration of citizenship,

• execution or restoration of documents

• registration of a residence permit in different countries,

• obtaining a weapon permit,

etc.

There are two types of certificates of criminal responsibility, the absence / presence of a criminal record or restrictions provided for by the criminal procedure legislation of Ukraine - the so-called “abbreviated” and “complete” certificates.

“Abbreviated” certificate will include information on the absence / presence of a criminal record, “complete” certificate - information on criminal prosecution, absence / presence of a criminal record or restrictions provided for by the criminal procedure legislation of Ukraine.

For each purpose, the legislation provides for a different amount of information about the individual. In some cases, the person has only to prove that she has no criminal record, in others it must be confirmed that the person not only has no criminal record, but has never been convicted, even if the previous criminal conviction according to the Criminal Code of Ukraine has been redeemed or removed. Sometimes the law provides for verification of personal-reference records in the event of bringing a person to criminal responsibility.
