A work permit is a document that is issued to a foreigner who intends to work in the territory of Ukraine, if there are adequate grounds for the application of expatriate labour, or if in the region there are no workers are able to perform this type of work.

A decision regarding the issuance or refusal to issue a permit to use labour of a foreigner is taken by the Director or Deputy Director of the employment center.

A decision regarding the issuance or refusal to issue a permit to use labour of a foreigner, prolongation of term of its action is taken within a period that may not exceed 30 calendar days from the date of receipt of the documents stipulated by the legislation.

A permit to use labour of a foreigner is issued for up to one year. For extension of the validity period, the employer shall submit to the employment center no later than one month before the expiry of the permission documents identified by applicable law.

A permit to use labour of a foreigner is the basis for obtaining a foreigner visa of the appropriate type, registration of temporary residence in Ukraine and obtaining a temporary residence permit on the territory of Ukraine.

In accordance with paragraph 5 of the decree of the Cabinet of Ministers of Ukraine No. 322 “On approval of the Procedure for issuing, renewal and revocation of permits to use labour of foreigners and stateless persons”. To obtain permission to employ a foreigner, the employer shall submit to the employment center with the following documents:

- statement;

- two color photographs of size 3.5 x 4.5 cm;

- substantiation of the expediency of employment of the foreigner and the possibility of establishing appropriate conditions for residence and employment;

- a copy of a draft employment agreement (contract) certified by the employer;

- certificate sealed and signed by the employer (in case of presence at the enterprise of regime-secret organ, also signed by the Director), that the workplace or position which will use the labor of an alien not related to the citizenship of Ukraine and not require the granting of access to state secret;

- a copy of the report submitted to the regional employment center (3-PN);

- reference from the district center of employment that the employer's debt to the Fund;

- certificate of state tax authority on payment of taxes and fees;

- certificate of the authorized authority of the country of origin (stay) that the alien is not serving a sentence for committing a crime and is under investigation (if at the time of a permit, the foreigner is outside of Ukraine);

- a copy of the document of the order, Protocol, instructions and the like), which certifies the right of a person to represent the interests of the employer in the employment center (certified by the company seal and signature of the head;

- copy of the Charter (notarized);

- a copy (both sides) of the certificate of state registration of the employer (notarized);

- a copy (both sides) reference of the state statistics Committee of amendments to the Unified state register of enterprises and organizations of Ukraine (EDRPOU (notarized);

- copies of documents on education or qualifications (notarized translation is required even with the Russian language, the notary shall certify the authenticity of copies, and the authenticity of the signature of the translator or the accuracy of the translation);

- copies of pages of passport (notarized translation into the Ukrainian language) ;

- the original old permit (in case of renewal);

receipt of payment for consideration of the application (4 minimum wages);
