Regarding the release of students called up for service during martial law.

So far, it is simply impossible for them to free themselves. That is, they are not subject to conscription, but if they have already entered the service, they cannot be released on the basis of training.

The draft law on amendments to Article 26 of the Law of Ukraine "On Military Duty and Military Service" regarding the dismissal of students, trainee assistants and graduate students can change the situation.

The purpose of draft law No. 8177 of November 4, 2022 is to preserve the scientific and technical potential of the country.

The draft law proposes to amend Article 26 of the Law of Ukraine "On Military Duty and Military Service", providing that during the special period and martial law, those who have obtained professional (vocational and technical), professional higher and higher education, trainee assistants, graduate students and doctoral students have the right to be exempted from military service (if, of course, being military personnel, they did not express a desire to continue military service).

The bill is designed to eliminate discrimination against the aforementioned category of citizens in regulatory acts. Since their right to postponement of the draft is enshrined in Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization".

However, the specific mechanism for implementing this right is absent in the relevant part of the Law of Ukraine "On Military Duty and Military Service" (Article 26).

The draft law will also help ensure the rights of persons who have already been mobilized due to ignorance of their rights.

This decision is caused by the need to preserve the economic level of development and scientific and technical potential of the country, which require the reproduction of a large reserve of specialists with a sufficiently high level of training.

In this way, the activities of educational institutions and research institutes will be preserved.

This will ensure the further development of the economy, the reproduction and development of high-tech sectors of the economy, in particular in the field of the military-industrial complex. In addition, all representatives of this category can continue their service at their own will, including under a contract.

This amendment will not harm the mobilization process, since people with a deferment can be called up in the future (for example, after completing education and acquiring additional skills, and mobilized people can continue military service at their own will).

It is planned that it will help ensure the rights of persons who have already been mobilized due to ignorance of their rights.

It is proposed to dismiss from military service:

•          vocational education students;
•          applicants of professional higher education;
•          students of higher education;
•          trainee assistants;
•          graduate students;
•          doctoral students
