The President of Ukraine Petro Poroshenko said that as commander in chief does not agree with the verdict, which sentenced the General to the conclusion of 7 years, thus putting in question the decision of one of the branches of government, the judiciary.

Recall that according to the Constitution of Ukraine in Ukraine there is a separation of powers into legislative, Executive and judicial. Each of these authorities shall act independently and in opposition to the other, keeping a balance of the legal state. The President does not belong to any and keeps to himself.

Evaluating only one court decision the President made an official statement about the desire change in the system of courts and announced that it plans to propose restoring special military courts in accordance with existing international practices.

However, he believes that justice must be achieved in court, but the decisions of the military courts was not questioned our soldiers.

Recall. In Ukraine earlier, there were military courts, which were abolished at the end of 2000-ies. The judges of these courts left to work in the judicial system and actually continue to hear cases, including for military crimes.

Military courts from the civil distinguished by the fact that funding was carried out by the Ministry of defence, which is not consistent with generally accepted international practice, because as you know who pays and has the ability to control. Recall that the Ministry of defence refers to the Executive branch of government, and the Minister of defence is directly appointed by the President and the latter is the Supreme commander.

After the liquidation of military courts was created by the judicial administration, which as an independent body deals with issues of financial security of all ships.

We believe that a return to the old system will create additional opportunities to influence the military courts from the Executive power and the President.
